These Terms of Service (“Terms”) govern access to and use of photographic works hosted on the Pixieset website operated by Rich Redmon d/b/a Photos by Rich (“Photographer”). By viewing, downloading, or sharing any image, you agree to be bound by these Terms.
1. Ownership and Copyright
All photographs, galleries, and associated media on this website are the sole property of the Photographer and are protected under Title 17 of the United States Code and international copyright treaties. Copyright is not transferred upon viewing, purchase, or download.
2. Permitted Personal Use
Players, families, and individuals are granted a limited, non-exclusive, non-transferable license to view, download, and share images for personal, non-commercial purposes such as personal printing, archiving, and personal social-media posting with credit to the Photographer.
3. Prohibited Uses
Without the Photographer’s express written consent, users may not:
a. Use any image for advertising, marketing, or organizational promotion;
b. Upload, publish, or distribute images on behalf of any business, brand, team, or league;
c. Sell, sublicense, or otherwise profit from any image;
d. Alter, crop, filter, or manipulate images, including removal of watermarks or metadata.
4. Commercial Licensing
Organizations, teams, schools, sponsors, media outlets, or third parties wishing to use any image for commercial, editorial, or promotional purposes must obtain a written license agreement and pay the applicable fee prior to use. Licensing inquiries should be directed to rich@photosbyrich.com.
5. Credit and Attribution
When sharing images online, users must provide visible credit such as “📸 Photo by Rich Redmon – Photos by Rich” or tag @rich_in_focus where applicable.
6. Enforcement and Remedies
Unauthorized use constitutes copyright infringement. The Photographer reserves the right to request immediate removal, issue a DMCA takedown, or pursue remedies available under 17 U.S.C. § 501–§ 505, including statutory damages and attorney’s fees for willful infringement.
7. Limitation of Liability
The Photographer is not liable for any loss, damage, or claim arising from unauthorized or improper use of any image. Access to this site is provided “as is” without warranty of any kind.
8. Amendments
These Terms may be updated at any time. Continued use of this website after such changes constitutes acceptance of the revised Terms.
